5.5.2. Hiring Temporary Workers

The company must formalize the working relationship with the permanent and temporary workers

engaged in various activities in the office, field or packing.

If the relationship with temporary workers is based on the Collective Agreement, the grower or the company must present proof of active partner, affiliated to the organism signing as employers’ representative.

If the grower or company establishes the relationship with its workers in an individual contract, it must contain at least the following: general data of the employee, contract duration, services to be provided, workplace, workday, days off, form and amount of salary, date and place of payment, and payment of benefits (vacation, vacation payment and bonuses).

In case that the contracts contain clauses that violate labor rights of workers, set out in the valid legislation, such clauses are void and contracts must be corrected.

5.5.3. Freedom of Association in Workers

Workers may organize freely and belong to groups formally or informally constituted, and join trade unions of agricultural workers, if they wish.

The company will respect those decisions and facilitate participation. Likewise, the company will document the type of organization to which its workers belong.
